MORTGAGEE’S SALE OF REAL ESTATE

By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Joanne Perry to Financial Freedom Senior Funding Corporation, a Subsidiary of Lehman Brothers Bank, FSB, dated August 28, 2003 and recorded in Plymouth County Registry of Deeds in Book 26403, Page 40 (the “Mortgage”) of which mortgage Bank of New York Mellon Trust Company, N.A. as Trustee for Mortgage Assets Management Series I Trust is the present holder by Assignment from Financial Freedom Senior Funding Corporation, a Subsidiary of Lehman Brothers Bank, FSB to Mortgage Electronic Registration Systems, Inc., A Delaware Corporation, its successors and assigns, as nominee for Financial Freedom Acquisition LLC dated October 27, 2009 and recorded at said Registry of Deeds in Book 37896, Page 25, and Assignment from Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Financial Freedom Acquisition LLC, its successors and assigns to Bank of New York Mellon Trust Company, N.A. as Trustee for Mortgage Assets Management Series I Trust dated March 22, 2022 and recorded at said Registry of Deeds in Book 56624, Page 63, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 2271 Cranberry Highway, West Wareham (Wareham), MA 02576 will be sold at a Public Auction at 1:00 PM on January 4, 2023, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit:

The land in that part of Wareham, Plymouth County Massachusetts, called West Wareham, together with the buildings thereon, bounded and described as follows:

Beginning at a Massachusetts Highway bound standing in the Westerly side of the New State Highway, through Tremont, said bound being Thirty-two and 70/100 (32.70) feet Southerly from Station No. 40 of the layout of said Highway in 1923, and running;
thence North 24 deg. 13’ 20” West by said Highway line, Thirty-one and 70/100 (31.70) feet to a stake standing in the Southeasterly corner of land now or formerly of Ramaldo and Francisco Gomes;
thence South 80 deg. 49’ 40” West by said Gomes land, Two hundred fifty and 00/100 (250.00) feet to a stake standing near the Easterly side of and old road lending from England Bridge to Tremont Iron Works;
thence South 31 deg. 01’ 40” West, One hundred thirty and 00/100 (130.00) feet, more or less, to a stake standing in or near the Westerly line of said New State Highway;
thence North 80 deg. 40’ 40” East, three hundred sixty-two and 00/100 (362.00) feet, more or less, to a stake standing in or near the Westerly line of said New State Highway;
thence Northwesterly by a curve to the left with a radius of One thousand seven hundred fifty-seven hundred fifty-seven and 08/100 (1,757.08) feet to a distance of Seventy and 94/100 (70.94) feet to said Massachusetts Highway Bound and point of beginning.

Together with all rights, privileges and easements connected therewith and subject to restrictions and casements of record and are hereby conveyed subject to any building and zoning law requirements which may he in force and applicable.
Being the same premises conveyed to the herein named mortgagor (s) by deed recorded with Plymouth County Registry of Deeds in Book 3992, Page 682.

The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.

Terms of the Sale: Cashier’s or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee’s attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee. The description for the premises contained in said mortgage shall control in the event of a typographical error in this publication.
