Legislators approve supplemental budget with measure to save district courts

The state House of Representatives and state Senate have passed legislation which will supplement the current state budget in various areas and, if ultimately approved, will allow the Wareham District Court to remain in operation.

The legislation will replenish various areas of the budget that were cut in July. The Wareham District Court was put on a list of 11 closures and relocations proposed in July after Governor Deval Patrick signed a $519.9 million state trial court budget.

The House inserted language into the bill that restricts the closure of any courthouses until the closure has been approved by the court administrator, said State Representative Susan Williams Gifford (R-Wareham).

A separate "Judicial System Reorganization" bill that, if passed, will take the operation of the state courts out of the hands of the Chief Justice and place them in the hands of a civilian "court administrator" is currently in conference committee, Gifford said.

The supplemental budget also includes language that would require a report including specific reasons for any court closure, a breakdown of cost savings, a plan to provide services to citizens affect by a closure, and among other things, the impact of the closure on other courts, would need to be filed before any closure could occur.

The House passed the bill on October 5. The Senate approved it after "hours of debate" on October 6, according to a statement from State Senator Marc Pacheco's (D-Taunton) office. The bill is now heading back to the state House of Representatives.

Legislators have opposed the proposed court closures, which they say would strain district courts and inconvenience law enforcement officials and citizens who need to get to court. If it were closed, Wareham District Court business would be moved to Plymouth.

Budget cuts also threatened to close the Wareham District Court a year ago. A bill similar to the one set to be debated on Wednesday helped save it and several other trial courts from closure at that time.

The Town of Wareham has already begun preparing for the potential closure of the Wareham District Court.

Voters at Town Meeting in October will be asked to approve the lease of a prisoner transport vehicle, which would help the town comply with specific requirements for transporting male, female, and juvenile prisoners to court. The vehicle will be needed if officers have to transport prisoners to Plymouth instead of just down Cranberry Highway, officials say.
