Man arrested for allegedly trying to rob gas station during Tropical Storm Irene

Wareham Police arrested a Franklin man on felony charges of breaking and entering after he allegedly tried to rob the Cape Cod Gas Station on Cranberry Highway during the wrath of Tropical Storm Irene on Sunday, August 28.

At the time of the call, police were assisting citizens with the affects of Irene, one of which was a loss of electrical power along the Cranberry Highway, according to a statement released by the Wareham Police Department.

Officer Michael Phinney responded to the gas station at 8:30 p.m. after a citizen observed a man breaking glass at the front of the building.

The man was later identified as 37-year-old Billy Mulvey of 130 Dean Ave. in Franklin, according to police. Evidence pertaining to the illegal entry was recovered at the scene, including tools commonly used during burglaries and items that were intended to be stolen, according to police.

Mulvey was placed under arrest and transported to Tobey Hospital where he was treated for minor lacerations that were apparently sustained from the broken window glass, police said.

Mulvey was later released and transported to the Wareham Police Department, where he is being held until arraignment at the Wareham Fourth District Court.

Mulvey was charged with breaking and entering during the nighttime, a felony, larceny from a building, malicious destruction of property, and possession of burglarious tools.

Police are continuing to investigate the incident.
