Wareham Board of Health fines shopping complex owner $1,000 for dirty parking lot
A dirty, garbage-filled parking lot netted the owner of the shopping complex at 419 Main St. a $1,000 fine from the Wareham Board of Health on Wednesday.
Joseph Iaciafano was fined $1,000 for not keeping the parking lot clean at the complex, which is home to a CVS, Dunkin Donuts, laundromat and liquor store.
Health Agent Robert Ethier said Iaciafano has been fined multiple times over the past three years for garbage found in the lot.
“He thinks it’s our responsibility to maintain his parking lot,” said Ethier. “It’s not. It’s our responsibility to enforce the law.”
Iaciafano was not present on Oct. 3 for the board’s meeting despite being ordered to appear. Board members noted Iaciafano had been called before the board on three different occasions recently and failed to appear each time. Instead, Joshua Kidd, who maintains several properties for Iaciafano in Massachusetts and Rhode Island, spoke with board members.
Kidd said he’s directed to clean the lot every two weeks.
“It should be once a day,” said board member Catherine Phinney.
Because of the repeated violations, Ethier said Iaciafano was in violation of a state nuisance law, which allowed the board to levy a higher fine. Board members originally considered a $500 fine.
Selectman Alan Slavin noted the board could attach a fine to Iaciafano’s tax bill in the future. Failing to pay would give the board additional options for compliance, including foreclosing on the property.
Board members said they would consider that and other measures if Iaciafano fails to maintain the lot going forward.
