Discrimination lawsuit filed against East Wareham property owner
Four defendants are facing a discrimination lawsuit filed by Attorney General Maura Healy for allegedly denying a Depot Crossing resident to have a service dog in his apartment.
The defendants are New Depot Crossing, LP; Hallkeen Management, Inc.; Housing Solutions for Southeastern Massachusetts, Inc.; and Diane Callahan, who manages Depot Crossing, located at 125 Minot Ave.
The defendants allegedly discriminated against a blind tenant by seeking a court order to remove his assistance animals rather than reasonably accommodating his disability. The tenant is blind and suffers from PTSD and relies on assistance animals.
The AG's Office is seeking injunctive relief and damages for the victim, as well as civil penalties, as a result of the defendants' alleged discriminatory and unlawful housing practices.
The defendants allegedly violated the state's fair housing law by requiring a specific form before considering the tenants request for a reasonable accommodation, inquiring into an open and obvious disability, and then failing to follow their own reasonable accommodation policies and procedures.
The complaint was filed Monday, July 25 in the Suffolk Superior Court.
It alleges that the defendants ultimately rushed to court to seek an order to remove the tenant's assistance animals rather than engage in an interactive dialogue as required by law.
