New law could allow zoning changes to pass with fewer votes

A change in state law could mean that zoning changes like the proposed Hospitality, Recreation, and Entertainment District could pass by simple majority at Town Meeting.

Historically, all zoning changes have required a two-thirds vote to pass. Recently, the state changed that rule to allow some zoning changes, particularly those that would allow more dense housing, to pass with only a simple majority.

Members of the Planning Board and Town Moderator Claire Smith briefly discussed that change at the board’s March 8 meeting.

The new rules are somewhat unclear, and so Smith said she was not able to definitively say whether or not the proposed district would need a two-thirds vote.

Smith and Town Counsel Richard Bowen are working with the state to determine what rules to follow at the April 10 Special Town Meeting where the district will be up for votes.
