Wareham man convicted of manslaughter denied new trial request

The state Appeals Court has upheld a ruling denying a request for a new trial in a 2006 case where a 39-year-old Wareham man was convicted of beating another man to death.

The April 13 decision affirmed a lower court’s ruling that prevented David E. Seeley from seeking a new trial. In 2009, he was convicted of manslaughter for the death of 53-year-old Manuel Andrews.

On July 1, 2006, Seeley encountered Andrews at a convenience store and punched him in the face over a prior argument. Andrews fell to the ground, and Seeley then dropped a 25-pound case holding lottery tickets onto the victim’s chest.

Seeley left the scene while Andrews was transported to a Boston hospital for treatment. However, Andrews died following the trauma.

Seeley’s defense argued before the Appeals Court that there were errors in several areas, including jury instruction, defense counsel and the prosecution.
