Director of Inspectional Services arraigned on domestic assault and battery charge
Director of Inspectional Services Myles Burke was arraigned on a charge of domestic assault and battery on Wednesday, August 8, at Wareham District Court.
According to police reports, a witness observed Burke hitting a female victim sitting in a car outside of Gateway Tavern in Wareham on Tuesday.
The witness then observed Burke "stumble" inside of the restaurant to use the bathroom, according to the report. Burke then attempted to get a drink, but the bartender refused to serve him, according to the police report.
Burke and the victim had arrived in the parking lot of the Gateway after leaving a restaurant in Mattapoisett, according to the police report. A friend had taken the keys from Burke because of his inebriated state and the victim drove, according to the report.
A police officer later arrived at the scene and interviewed the victim and Burke. The officer "could detect a strong odor of alcoholic beverages coming from his breath," according to the report.
After investigating the incident, Burke was transported to the police station where he refused to take a "breath test," according to the report.
Burke was released by the court after his arraignment with Judge Therese Wright adding the condition that he "refrain from abusing" the victim.
Burke will next appear in court for a pre-trial at Wareham District Court on September 27.
Burke has served as the town's Director of Inspectional Services since April, 2010. Since that time, he has been pursuing certification that state officials say is necessary for him to continue his work as a building official.
Officials, however, maintain that Burke lacks the minimum experience to even be able to sit for the exam. In July, Burke was again denied his request to take the state building official certification exam. He says he'll appeal. For that story, click here.
