Wareham men in tow truck arrested on heroin charges

Two Wareham men in a J&R Towing truck were arrested after they were allegedly found in possession of heroin Thursday morning, Feb. 5.

Maxx Phillips, 29, and Joshua McKee, 40, both of Wareham, were arrested on Swifts Beach Road at 10 a.m. Thursday, police said.

According to court documents, the pair was seen entering the Woods at Wareham apartment complex in the tow truck shortly before 9:30 a.m.

Phillips was identified by a surveilling Wareham detective because he is “known to Wareham Police as a known user of illegal narcotics,”  according to court documents.

The detective saw Phillips walk to the back of an apartment in the Woods at Wareham “well known as a distribution point of drugs” shortly after 9:30 a.m., court documents said.

Wareham detectives and patrol officers conducted a motor vehicle stop of the tow truck on Swifts Beach Road at 10 a.m.

During the traffic stop, officers and detectives located a cigarette package containing “powder consistent with heroin” in possession on Phillips, the passenger.

Police also found a syringe filled with brown liquid in the truck, as well as a spoon and an open bottle of water, items consistent with heroin use, according to documents.

Phillips was charged with possession of a class A substance (heroin) and conspiracy to violate the Controlled Substance Act.

McKee was charged with knowingly being present where heroin is kept and conspiracy to violate the Controlled Substance Act.

Both were released on personal recognizance and have a pretrial hearing scheduled for March 12.
